1. OVERVIEW

At ZOWN REALTY CALIFORNIA INC. ("Zown," "we," "us," or "our"), we connect first-time homebuyers and sellers through innovative real estate solutions via our website and other internet-based tools. Our services are designed to support both buyers and sellers by offering more flexible, transparent, and user-centered options. These Terms and Conditions ("Terms") govern your use of our services and website. By accessing or using Zown's platform, you agree to be bound by these Terms.


2. SERVICES FOR BUYERS

Zown offers upfront down payment boost options to eligible homebuyers. These boosts are structured as interest-free advances, which may either be forgiven when you sell your home through Zown or subject to repayment under predefined terms if the property is sold through another party. Terms vary by package and will be disclosed before your commitment. Zown's Down Payment Boost is offered by Zown Technologies Inc., a separate entity from Zown Realty California Inc. Mortgage services are provided by Bison Ventures, a licensed mortgage broker in California. Zown does not guarantee mortgage approval and is not a direct lender.


3. SERVICES FOR SELLERS

Sellers working with Zown may benefit from flat-fee or reduced-commission packages, with enhanced pricing available to those who also buy with Zown. Terms vary based on level of engagement and services selected.


4. AGREEMENT TO TERMS

By using Zown's website or services, you agree to these Terms in full. If you do not agree, you may not access or use our platform. For questions or clarification, contact us at hello@zownhomes.com before proceeding.


5. PRIVACY POLICY

Our Privacy Policy explains how we collect, use, and protect your personal information. California residents have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), as outlined in our policy.


6. USER RESPONSIBILITIES

Users agree to provide accurate, complete, and up-to-date information when using our services. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You may only use Zown for lawful and intended purposes, and you must not attempt to interfere with our systems, access restricted areas, or misrepresent your identity or intentions.


7. INTELLECTUAL PROPERTY

All content, service models (including the Down Payment Boost and commission pricing), and associated intellectual property are proprietary to Zown. You may not copy, adapt, distribute, or otherwise use any part of our platform, processes, or tools without express written consent.


8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Zown is not liable for any indirect, incidental, or consequential damages resulting from your use of or inability to use our services. We do not guarantee the accuracy of third-party data, the outcome of any transaction, or approval of financing. Our total liability to you, in any case, will be limited to the amount you paid (if any) for using our services.


9. DISPUTE RESOLUTION

If you have a dispute with Zown, you agree to first attempt to resolve it informally by contacting us directly. If we are unable to reach a resolution, you agree that the dispute will be resolved through binding arbitration under California law. You also agree to resolve disputes individually and waive any right to participate in a class action or collective claim.


10. PROPRIETARY TERMS

The terms, conditions, and unique service structures offered by Zown, including our down payment boost and commission model, are proprietary and exclusive to ZOWN REALTY CALIFORNIA INC. Unauthorized use, reproduction, or adaptation of our service structures or pricing models is prohibited.


11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, ZOWN REALTY CALIFORNIA INC. is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. This includes any loss of profits, data, or other intangible losses resulting from your use of or inability to use our services. Zown's liability, in any case, will be limited to the amount paid by you, if any, for accessing or using our services.


12. GOVERNING LAW

For California-based users, these Terms are governed by the laws of the State of California. Any legal proceedings or arbitration will take place in the county where Zown's principal California office is located, and both parties agree to that jurisdiction.


13. DISCLAIMERS

Zown Realty California Inc. is a licensed real estate brokerage in the state of California. Zown Technologies Inc. is a separate entity offering financial assistance tools like the Down Payment Boost. Mortgage services are provided exclusively by Bison Ventures, a licensed mortgage broker. Zown is not a direct lender and does not guarantee financing. MLS® and REALTOR® are trademarks owned by the National Association of REALTORS® and are used under license. All property data is deemed reliable but not guaranteed and is intended for personal, non-commercial use only by consumers.


14. AMENDMENTS

We may update or amend these Terms at any time. Updates take effect once posted, and we encourage users to review them regularly. For major changes, we will make reasonable efforts to notify you through our website or by email.
